Welcome to the mywaydress terms and conditions, which apply to all items ordered from mywaydress.com. Please read through before placing your order. By using this website and placing an order you agree to be bound by the terms and conditions set out below. Please also read our Privacy Policy below regarding personal information provided by you. I. General
MYWAYDRESS, operates an online shop at the internet address www.mywaydress.com (the “Website”). All orders placed by you via the Website as well as our deliveries and services are governed exclusively by the Terms and Conditions of Business set out below, as applicable at the time the order is placed. We do not accept any diverging terms and conditions from the customer.
- United Arab of Emirates is our country of domicile and the governing law is the local law.
- Customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.
- Cardholder must retain a copy of transaction records and Merchant policies and rules.
- User is responsible for maintaining the confidentiality of his account.
- We will not trade with or provide any services to OFAC and sanctioned countries.
II. Contract
The presentation of products on our Website does not constitute any offer by mywaydress.com for a purchase contract. By submitting the order form provided on our Website to us you are placing a binding offer for a purchase contract with us. You submit an offer by entering all required information during the ordering process and posting the order form to us by using the button “place order”. Before you submit your offer you will be able to view the details input by you and correct any mistakes in the information provided.
On receipt of your order we will send you an e-mail confirming receipt of your order and stating the details of your order (order confirmation). Please note that our order confirmation does not constitute a declaration of acceptance of your contractual offer but serves for information purposes only. A purchase contract between you and mywaydress.com will become effective only after we have accepted the offer by dispatching the goods ordered.
We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following: the product ordered being unavailable from stock, our inability to obtain authorization of payment, the identification of an error within the product information, including price or promotion or if we suspect any fraudulent activity.
If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time. Prices do not include VAT (where applicable).
III. Cancellation policy
Consumers are all individuals that complete a transaction that is not attributable to their commercial or self-employed occupation. Consumers can cancel their order within 24 hours; refunds will be made back to the payment solution used initially by the consumer. Please allow for up to 45 days for the refund transfer to be completed. To administer your right to cancel your order, you have to inform us via customercare@mywaydress.com.
IV. Voluntary returns
mywaydress.com also offers the following voluntary right of return: All of the items featured on mywaydress.com can be returned to mywaydress.com within 14 days of receipt. The voluntary right of return only applies to non-faulty items that are in their original condition, have not been worn, altered or washed; with all tags attached. Return shipments - all return shipments will be at your expense. Please note that we can only accept returns from the country which the shipment was sent to. In case of a return, we will refund the money for the product onto your account/credit card. In case of a return, customs duties and handling fees can not be refunded. Potential losses due to currency fluctuations will not be refunded.

V. Prices; Product presentation;
The prices stated on our website www.mywaydress.com at the time of your order apply. The price does not include the costs of import clearance, fees and other administrative and tax charges (PDV, VAT, DDV or the like) in the country to which the goods are delivered. Buyer assumes the import clearance duty and bears the costs of fees and other administrative and tax charges. The images displayed in the virtual designer are a representation only, the actual dress that is custom made for you may differ to the represented images. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery. Please refer to the size guide for clarification of the sizes and measurements.
VI. Storage of contract data
We store your order data. You will receive an email order confirmation stating all details entered.
VII. Production time, shipping dispatch
Production time of your dress and delivery takes 10-15 working days from the date of your order. The order will be sent to production only after the full purchase price has been credited to our account. Your package will be shipped via Croatian Post service. mywaydress.com is not liable for any potential transport risks.
VIII. Payment; Setoff; Right of retention
Accepted methods of payment Please pay for your mywaydress.com order by: Credit card via payment gateway. All payments and credit notes will be handled in AED and USD.
Set-off The customer is barred from a set-off if the counter claim has no legal backing, was not unanimously decided upon, and is not undisputed or if a separate claim for damages is covered in the same sales contract.
Right of retention for commercial transactions In mercantile trade, the right to the retention of goods and a service disclaimer by the customer cannot be enforced, with the exception of undisputed, legally determined counter claims or claims for damages covered in the same sales contract.
IX. Retention of title
The goods delivered remain property of mywaydress.com until full payment has been made.

XI. Warranty
Claims based on defects in the delivered goods shall be governed by the applicable legal provisions, to the exception that any claims for damages relating to defects shall be subject exclusively to section 12 below.
XII. Governing law, severability
All legal disputes arising out of or in connection with a purchase contract shall be governed exclusively by Croatian law to the exclusion of the UN Sales Convention. If any provision is invalid, nothing in this shall prejudice the validity of the remaining provisions hereof
